Terms of Service

Please read these Terms of Service carefully before using any FieldDesk application. By creating an account or using our services, you agree to be bound by these terms.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and MyFieldDesk LLC ("MyFieldDesk," "we," "us," or "our"), a Florida limited liability company, governing your access to and use of the FieldDesk suite of applications, including AirDesk, CleanDesk, VoltDesk, FlowDesk, and any future applications (collectively, the "Service").

By accessing or using the Service, you confirm that you are at least 18 years old, have the legal authority to enter into this agreement, and agree to comply with and be bound by these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Description of Service

MyFieldDesk provides cloud-based field service management software designed for trade contractors. The Service includes tools for scheduling, job management, customer records, invoicing, estimates, quoting, and related business operations. Features vary by subscription plan.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for:

4. Subscription Plans and Billing

The Service is offered on a subscription basis. Current plan pricing is as follows:

Enterprise $199/month Everything in Pro plus route optimizer, priority support

Add-ons (such as Route Optimizer for Pro plan) are billed in addition to the base subscription fee. Prices are subject to change with 30 days advance notice.

Subscriptions are billed monthly in advance. Payment is processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. All fees are in US dollars and are non-refundable except as required by law or as described in Section 5.

5. Free Trial and Cancellation

We may offer a free trial period for new accounts. No credit card is required during the trial period. At the end of the trial, you will be prompted to select a paid plan to continue using the Service.

You may cancel your subscription at any time through the Settings section of your account or by contacting us at support@myfielddesk.app. Cancellation takes effect at the end of the current billing period. You will retain access to the Service through the end of your paid period. We do not provide refunds for partial months.

6. Acceptable Use

You agree to use the Service only for lawful business purposes. You may not:

You retain ownership of all data, content, and information you upload or enter into the Service ("Your Data"). You grant MyFieldDesk a limited, non-exclusive license to use Your Data solely to provide and improve the Service.

You are responsible for the accuracy and legality of Your Data, including compliance with applicable privacy laws when storing customer information in the Service.

We will not sell Your Data to third parties or use it for advertising purposes. For details on how we handle your data, see our Privacy Policy.

8. Intellectual Property

The Service, including all software, design, content, features, and functionality, is owned by MyFieldDesk LLC and is protected by copyright, trademark, and other intellectual property laws. The FieldDesk brand names — including AirDesk, CleanDesk, VoltDesk, FlowDesk, and MyFieldDesk — are proprietary to MyFieldDesk LLC.

These Terms do not grant you any right to use MyFieldDesk's trademarks, logos, or brand names. Nothing in these Terms grants you a license to the underlying software beyond what is necessary to use the Service as intended.

9. Third-Party Integrations

The Service integrates with third-party services including QuickBooks (Intuit), Stripe, and Google Maps. Your use of those integrations is subject to the respective third party's terms of service and privacy policy. MyFieldDesk is not responsible for the availability, accuracy, or actions of third-party services.

10. Referral Program

MyFieldDesk may offer a referral program whereby you can earn commissions for referring new paying customers to the Service. Referral program terms, commission rates, payout schedules, hold periods, and clawback provisions are described in the Referral Program Terms, available in your account Settings. MyFieldDesk reserves the right to modify or discontinue the referral program at any time with reasonable notice.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

MyFieldDesk does not warrant that the Service will meet your specific business requirements. You are responsible for independently verifying that the Service is suitable for your needs.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYFIELDDESK LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless MyFieldDesk LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Service shall first be attempted to be resolved informally by contacting us at support@myfielddesk.app.

If informal resolution fails, disputes shall be resolved by binding arbitration in Lee County, Florida, in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property claims.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page, updating the "Last updated" date, and sending a notice to the email address on your account. Your continued use of the Service after such notice constitutes acceptance of the updated Terms.

16. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms, non-payment, or for any other reason at our sole discretion, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections 7, 8, 11, 12, 13, and 14 survive termination.
